PRICE OF ITEMS

The prices applicable to the products are those listed at the time of the order and all include taxes (VAT or similar). The breakdown of these taxes will be provided to you before the order is finalised and formalised. Please note that when you formalise the order, the system will inform you in detail of the total taxable amount of the order, the applicable taxes and the corresponding shipping costs.

Taxes, fees and shipping costs will vary depending on the tax or physical area from where the order is placed or must be shipped, so they may be modified or discounted after selecting the shipping area.

Offers or discount vouchers may have an expiration date after which they are no longer valid.

The prices displayed on the platform may be reviewed and modified at any time as they are subject to changes in the market.

PAYMENT METHODS

Purchases of products and services may be paid for by credit or debit card in the purchase section or by formalizing the purchase through an electronic POS enabled for this purpose.

Payment by credit or debit card

If you would like to pay for your purchase by credit or debit card, the payment will be managed through a payment gateway on a secure server.

All your data will be encrypted and will travel on a secure SSL ("Security Socket Layers") server, guaranteeing that neither the owners of this Virtual Store nor third parties will have access to your bank or credit card data.

The bank will then validate your credit card and proceed to charge it. At that time, the order will be effective and will be processed and shipped.

SHIPPING AND DELIVERY

The products that appear on the website with their unit price correspond to the total price, including taxes and do not include shipping and customs costs.

Shipping and customs costs will be borne by the customer, who will be informed at all times before accepting the order. The purchased products will be delivered to the person/company and at the address indicated, within the time indicated for each type of shipment.

Shipments will be delivered within approximately 1-2 days for the national territory from receipt of payment and depending on stock availability.

For the delivery of the order, Saturdays, Sundays and holidays (both national and local) will not be counted.

If the product is not in stock, the delivery time may be delayed depending on the time it takes our suppliers to replenish it. In this case, Noumad declines all responsibility and will inform the customer of the estimated time of receipt by us.

Orders will not be delivered to PO boxes and we reserve the right to hold orders with incorrect addresses. Our customer service department will contact you using the information provided for any incident or query that may arise in the processing of your order.

AVAILABILITY

NOuMAD will do everything possible to satisfy all its customers in the demand for its products.
In the event of unavailability of the product after the order has been placed, the customer will be informed of its cancellation.

SHIPPING COSTS

NOuMAD currently ships to all of Europe and to Spain: the Peninsula and the Balearic Islands. For now, shipments are not made to the Canary Islands, Ceuta and Melilla.

Spain (mainland and Balearic Islands): free shipping for orders over €200, otherwise the cost is €6.

Note-Customs:

The sale of our products outside the Peninsular territory to countries of the European Union are exempt from VAT (unless the total value of annual sales to said country is below the limit established by its authorities). However, the customs system will apply the corresponding tax charges at each customs office, which will always be the responsibility of the customer and at the time of delivery of the package. We cannot calculate the amount to be paid in advance, since it depends on the regulatory bodies of each of the destination countries and their customs.

You can contact your local customs offices to request detailed information about these charges.

RETURNS

If for any reason you are not satisfied with your order, you have 30 business days from the date of receipt of the order to make the exchange or return. In case of online purchase, the refund will be made within 14 calendar days from when the consumer exercises his right of withdrawal .

  • The exchange of a product must always be for another of a lower or equal value.
  • In case of exchange for a product of higher value, the difference must be paid in advance.

You can exchange any product for a voucher with a 1-year expiration date for an amount equal to that of the product to be exchanged.

Due to the nature of the orders and in accordance with article 45 of Law 7/1996 of January 15 on Retail Trade, there will be no right of return in the case of those goods manufactured according to the customer's specifications or that have been clearly made to measure for the same or that as a consequence of their state or condition do not meet the appropriate conditions for return.

The company guarantees that the services will be performed in accordance with the terms set out in the offer. It also undertakes to remedy any defect that is a direct consequence of improper provision of the services. For these purposes, the following rules shall be taken into account:

(a) When the effect consists of a defect in the delivered product, the remedy will consist, to the extent possible, in the repair or replacement of the defective product;
(b) When, due to the nature of the service, it is not possible to repair or replace the defective product, the customer will be offered the most favorable technical and economic solution.
(c) As a subsidiary, if the correction in accordance with the rules provided in sections (a) and (b) above is not satisfactory, the client shall have the right to demand a reduction in the price or terminate the contract, with a refund of the price paid.

The company reserves the right to examine any defects alleged by the customer.

The liability assumed by the company will be limited to the correction. The company will not be liable for any incidental damages that may arise from the execution of the services. This category includes, but is not limited to, damages due to loss of data, files, images, information, opportunities or benefits and moral damages.

The company shall not be liable for any colour differences between the original image and the supplied product, which are caused by a defective quality of the original image file. Claims for reasons of aesthetic taste shall not be considered as defects in the goods.

The guarantees and responsibilities provided for in this clause shall not be applicable when the damage or defect is due to force majeure or a cause attributable to the customer. In any case, the guarantee offered here replaces any other guarantees.

The regime provided for in this clause shall not be applicable to persons acting as consumers in accordance with Spanish legislation, provided that a Judge or Court considers that the limitations provided for herein are contrary to the basic rights of the consumer. The same rule shall apply in cases where fraud or gross negligence is observed in the performance of the services.

As a client, you will be liable to the company and to third parties holding industrial or intellectual property rights as a result of your use of our services. You will also exempt these persons from claims by third parties.

If you wish to make a return, please check that you meet all of the following requirements before sending the product back to us:

The product must be accompanied by its original packaging and properly sealed.

To make a return, please contact the following email address: shop@noumad.com, indicating personal details, order number and the reason for the order to authorise the return. Once we receive this email, we will tell you how to make the return. Without prior authorisation from us, the product will not be accepted and will consequently be returned to its origin, with the customer bearing the shipping costs.

Once we receive the merchandise, we will check that all the aforementioned requirements are met and, if applicable, Noumad will proceed to exchange the item for another or refund the money, if requested by the customer.

If the return is due to a preparation error or due to damaged products, the return shipping costs will be borne by us. On the other hand, if the return is due to any other reason, the return shipping costs will be borne by the customer.

We recommend checking the order at the time of delivery by the transport agency, and recording it on the delivery note and signing it.

WARRANTY

Guarantees and after-sales services are governed by Royal Legislative Decree 1/2007 of 16 November, which approves the text of the General Law for the Protection of Consumers and Users. According to this regulation, the seller is obliged to deliver to the consumer and user products that comply with the contract, and is liable to the consumer and user for any lack of conformity.

MODIFICATION OF THE GENERAL CONDITIONS OF SALE

Noumad reserves the right to modify the general conditions of sale without prior notice, and may change, delete or add content and services provided through the site, as well as the way in which they appear presented or located on its servers.
These changes must be accepted by the User through the Noumad website.
Customers who do not agree with the changes to the general conditions must notify Noumad. In the event that any of the terms of the general conditions is illegal or unenforceable, it will be null and void and the agreement between the parties will apply, and in the absence thereof, the provisions of the Spanish Civil Code.

TERMS OF USE

To consult and search for the products of your interest, you can do so through the different navigation menus or by using the advanced search.

Products are listed with their unit price, which corresponds to the total price including VAT, not including transport and customs costs, if applicable.

Shipments will be delivered within approximately 1-2 days for the national territory from receipt of payment and depending on stock availability.

LIABILITY, LITIGATION AND APPLICABLE LEGISLATION

Noumad cannot be held liable for any breach of contract in the event of stock shortages or unavailability of the product, force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood or fire. In the event of a dispute, the member will first contact Noumad to obtain an amicable solution.

These general conditions of sale will be interpreted in the Spanish language and will be carried out in accordance with Spanish law.

For the resolution of all disputes or issues related to this website or the activities carried out on it, Spanish legislation will apply, to which the parties are subject, and the Courts and Tribunals of the city of the person responsible for the file will be competent for the resolution of all conflicts derived from or related to its use.
